Welcome to Píng, a trading name of Eat Ping Ltd. ("Píng"). Please read these Terms of Use ("Terms") carefully before using this website ("Site").
1. Acceptance of Terms
By accessing and using our Site, you agree to abide by these Terms and any amendments thereto. If you do not agree to these Terms, please do not use our Site.
2. Changes to Terms
We may update these Terms at any time without notice. The most current version of the Terms can be reviewed by clicking on the "Terms of Use" hyperlink at the bottom of our web pages.
3. Use of the Site
You agree to use our Site for lawful purposes only. You shall not post or transmit through our Site any material which violates or infringes in any way upon the rights of others, which is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane or otherwise objectionable.
4. Account Creation / Subscription Process
During the account creation / subscription process we may collect certain personal and financial information about you. Please review our Privacy Policy for details on how we collect, use, and protect your information.
5. Subscription Fee
In order to use our products, you will be required to pay a subscription fee. Further details about the subscription fee and the terms related to it will be provided to you during the account creation / subscription process.
6. Intellectual Property
All content included on this Site, such as text, graphics, logos, images, and software, is the property of Píng or its content suppliers and is protected by international copyright laws.
7. Delivery and Delivery Period
7.1 Delivery days. Eat Ping delivers on Sundays and Mondays only. Your delivery day is determined by your delivery postcode and will be confirmed to you at sign-up and on each order confirmation. Eat Ping may change the delivery day allocated to a postcode area, and will give you reasonable notice before doing so.
7.2 Order cut-off. To receive a delivery on your allocated day, your order must be confirmed by Tuesday 11:00am in the week preceding delivery. Orders confirmed after the cut-off will be scheduled for the following delivery week. Payment must be successfully taken at or before the cut-off; where payment fails, Eat Ping may cancel or reschedule the order.
7.3 Delivery window. Deliveries are made between 8:00am and 19:00 on your allocated day. Eat Ping will endeavour to notify you of a narrower estimated window on the day of delivery, but delivery windows are estimates and are not guaranteed.
7.4 Delivery areas. Eat Ping delivers only to addresses within its published delivery areas. Deliveries cannot be made to PO Box addresses. If your postcode falls outside the delivery area, Eat Ping will not be able to fulfil your order and will refund any sums paid for it.
7.5 Third-party couriers. Eat Ping uses third-party couriers to deliver orders. Delivery records, including proof of delivery, photographic evidence, GPS data or courier run-sheets, will be treated as evidence that the order was delivered to the address provided.
7.6 Accuracy of delivery details. It is your responsibility to ensure that the delivery address, contact telephone number and any access instructions held on your account are accurate and up to date. You must provide a telephone number on which you can be reached on your delivery day. Eat Ping is not responsible for a failed or delayed delivery caused by inaccurate or incomplete delivery details.
7.7 Changing your delivery address. You may amend your delivery address in your account up to the cut-off in clause 7.2. After the cut-off, your order will already have been scheduled for production and dispatch and an address change may not be possible. Where a change is made after dispatch, additional charges may apply and Eat Ping cannot guarantee that the order will be delivered.
7.8 Unattended delivery and chilled goods. Eat Ping’s meals are chilled, perishable food supplied in insulated packaging designed to hold a safe temperature for a limited period after delivery. Where you are not present at the time of delivery, or where you have nominated a safe place, neighbour, concierge, reception or other third-party location to receive your order, the courier may leave the order there and the delivery will be treated as completed. You are responsible for retrieving your order promptly and refrigerating it as soon as possible after delivery. Eat Ping is not responsible for deterioration in the condition or safety of the food where an order has been delivered as instructed and has been left unrefrigerated by you or by a person you nominated.
7.9 Failed and undelivered orders. If your order does not arrive on your allocated delivery day, or arrives incomplete, you must notify Eat Ping within 48 hours of your scheduled delivery. Because the products are perishable, claims made outside this period cannot be investigated reliably and Eat Ping may be unable to offer a refund or replacement where a valid proof of dispatch and delivery exists against the order.
7.10 Condition on arrival. If any item arrives damaged, leaking, or above a safe temperature, do not consume it. Notify Eat Ping within 24 hours of delivery, with photographs where possible, and Eat Ping will offer a refund or account credit for the affected items in accordance with its Refunds Policy.
7.11 Split deliveries. Eat Ping may dispatch an order in more than one parcel or consignment. Any additional delivery costs arising from a split dispatch will be borne by Eat Ping unless otherwise agreed with you.
7.12 Delays outside Eat Ping’s control. Eat Ping will not be liable for delays or failures to deliver caused by events outside its reasonable control, including adverse weather, courier network failure, road closures, industrial action, or supply chain disruption. Where such an event affects your delivery, Eat Ping will contact you as soon as practicable and will offer a redelivery, a refund, or account credit for the affected order. Nothing in this clause limits your legal rights as a consumer, or Eat Ping’s liability for death, personal injury, or fraud.
7.13 Refused or rejected deliveries. Where a delivery cannot be completed because access is refused or unavailable, the address is inaccessible, or no safe place is available and no valid contact details have been provided, the order may be returned or disposed of. Because the products are perishable, Eat Ping is unable to redeliver returned orders and no refund will be due in these circumstances.
7.14 Pausing and skipping. You may pause your subscription or skip a delivery week in your account, provided you do so before the cut-off in clause 7.2. Changes requested after the cut-off cannot be applied to that week’s delivery and the order will be charged and delivered as scheduled.
7.15 Delivery charges. Delivery charges, and any minimum order value, are as displayed at checkout or in your subscription plan at the time your order is confirmed.
8. Availability and Substitutions
8.1 Menu availability. Eat Ping’s menu rotates and individual dishes are available in limited quantities. Where a dish you have selected becomes unavailable after your order is confirmed, Eat Ping will substitute an alternative dish of equal or greater value wherever possible, or refund or credit the value of the affected item.
8.2 Substitutions and dietary requirements. Substitutions will be made having regard to any allergen or dietary information recorded on your account. It remains your responsibility to check the allergen information supplied with each delivery before consuming any product. If you have a severe allergy, do not rely on substitution alone — contact Eat Ping before your cut-off to confirm suitability.
8.3 Ingredient variation. Recipes, ingredients, and nutritional values may vary between production runs due to seasonality and supply. The information supplied with your delivery takes precedence over any information previously published on the website or in marketing materials.
8.4 Fulfilment failure. Where circumstances outside Eat Ping’s control mean an order cannot be produced or fulfilled at all — for example a production outage, ingredient shortage, or facility closure — Eat Ping’s liability is limited to a refund or account credit of the sums you have paid for that order.
8.5 Cancellation and perishable goods. Because Eat Ping’s products are perishable food prepared to order, the statutory 14-day right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 does not apply to individual deliveries once they have been confirmed for production. You may cancel your subscription at any time, with effect from the next delivery week, provided you cancel before the cut-off in clause 7.2. This does not affect your rights in respect of products that are faulty, unsafe, or not as described.
9. Limitation of Liability
Píng will not be liable for any damages of any kind arising from the use of this Site or from any information, content, materials, products or services included on or otherwise made available to you through this Site.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England. Any disputes relating to these Terms shall be subject to the exclusive jurisdiction of the courts of England.
